Verdict on Article 370 – Supreme Court calls for restoration of J&K statehood

  New Delhi: The Supreme Court on Monday said Article 370 of the Constitution was only temporary and the President's power to abrogate it still exists. A five-bench Constitution bench comprising CJI DY Chandrachud and Justices Sanjay Kishan Kaul, Sanjiv Khanna, BR Gavai and Surya Kant was delivering its verdict on a batch of petitions challenging the abrogation of Article 370.

  The apex court upheld the Modi government's decision to remove Article 370, which gave special status to Jammu and Kashmir, and said that steps should be taken to hold assembly elections by September 30 next year.

  CJI Chandrachud said, "Article 370 of the Constitution was an interim arrangement due to the war situation in the state. The Constituent Assembly of Jammu and Kashmir was never intended to be a permanent body."

Rejecting the petitioners' contention that no irreversible action can be taken by the Center during President's rule, the top court said, "Every decision taken by the Center on behalf of the state during President's rule cannot be challenged. "

  The Supreme Court also upheld the reorganization of Ladakh as a Union Territory. So now this can be done with anyone. Now in the coming days, BJP will try to make Kolkata, Chennai, Hyderabad and Mumbai as Union Territories and no one will be able to stop it.

  Owaisi said that removing Article 370 is a violation of constitutional morality and dividing the state into 3 union territories is a big betrayal of the people of Kashmir.

नई दिल्ली: सुप्रीम कोर्ट ने सोमवार को कहा कि संविधान का अनुच्छेद 370 केवल अस्थायी था और इसे निरस्त करने की राष्ट्रपति की शक्ति अभी भी मौजूद है। सीजेआई डीवाई चंद्रचूड़ और जस्टिस संजय किशन कौल, संजीव खन्ना, बीआर गवई और सूर्यकांत की पांच-पीठ की संविधान पीठ अनुच्छेद 370 को निरस्त करने को चुनौती देने वाली याचिकाओं के एक बैच पर अपना फैसला सुना रही थी।

 शीर्ष अदालत ने जम्मू-कश्मीर को विशेष दर्जा देने वाले अनुच्छेद 370 को हटाने के मोदी सरकार के फैसले को बरकरार रखा और कहा कि अगले साल 30 सितंबर तक विधानसभा चुनाव कराने के लिए कदम उठाया जाना चाहिए.

CJI Chandrachud ने कहा, "संविधान का अनुच्छेद 370 राज्य में युद्ध की स्थिति के कारण एक अंतरिम व्यवस्था थी। जम्मू-कश्मीर की संविधान सभा का कभी भी स्थायी निकाय बनने का इरादा नहीं था।"

याचिकाकर्ताओं की इस दलील को खारिज करते हुए कि राष्ट्रपति शासन के दौरान केंद्र द्वारा कोई अपरिवर्तनीय कार्रवाई नहीं की जा सकती, शीर्ष अदालत ने कहा, "राष्ट्रपति शासन के दौरान राज्य की ओर से केंद्र द्वारा लिए गए हर फैसले को चुनौती नहीं दी जा सकती।"

सप्रीम कोर्ट ने केंद्र शासित प्रदेश के रूप में लद्दाख के पुनर्गठन को भी बरकरार रखा। तो अब ये किसी के भी साथ किया जा सकता है. अब आने वाले दिनों में बीजेपी कोलकाता, चेन्नई, हैदराबाद और मुंबई को केंद्र शासित प्रदेश बनाने की कोशिश करेगी और इसे कोई रोक नहीं पाएगा.

 ओवैसी ने कहा कि अनुच्छेद 370 हटाना संवैधानिक नैतिकता का उल्लंघन है और राज्य को 3 केंद्र शासित प्रदेशों में बांटना कश्मीर के लोगों के साथ बड़ा धोखा है.
